Mission Elite Performance Programs and Services Contract

This document is a recognition of the agreement made between the purchaser and/or participant of the program or service and Mission Elite Performance. The purpose of this contractual agreement is to allow parents and players to give informed consent for a player to participate in any Mission Elite Performance programs and/or services. By checking the service agreement box, you now agree to the following terms in this contract by Mission Elite Performance.

Section #1: Refund Policy
There will be no refund on the amount paid through online registration or other methods of registration due to the following;
● Extreme Illness/Injury (that will be reviewed and judged by Mission Elite Executive Staff)
● Personal Issues & Conflicts (that will be reviewed and evaluated by Mission Elite’s Executive Staff)
The refunds will only apply if Mission Elite performance is notified 14 days before the specified week of training starts. Please note a 7.9% processing fee will be deducted from your refund and/or any scheduling changes.

Section #2: On-Court Injuries & Incidents
Mission Elite Performance coaches and support team will be at in-person programs and or services to supervise and take care of the players. However, Mission Elite Performance will not be held liable for any injuries and/or incidents that occur on or off the court during scheduled programming.

By agreeing to these terms and conditions, you authorize the staff of Mission Elite Performance to act according to their best judgment in any emergency requiring medical attention. You release Mission Elite Performance from any and all liability for injury or illness and costs incurred while undertaking a program or event with Mission Elite Performance.

Section #3: Behavior & Coaching Standards:
The purchaser and/or participant of the program or service must meet and fulfill all program expectations, including the Mission Elite Values, Duties, Expectations, and Consequences. Any serious violations of these values and expectations can result in expulsion from the program.
Expectations:

Mission Elite expects respect from the players and parents towards the coaching staff.
Mission Elite expects effort from the players at all times.
Mission Elite does not tolerate offensive or inappropriate language on or off the court.
Mission Elite does not accept aggressive and adverse reactions and behaviors.

Section #4: Fitness to Participate
The purchaser and/or participant of the program or service agrees and acknowledges that he/she is physically and mentally able to participate in the program and has no current or prior physical or mental conditions that would present a risk to other players, parents, and/or coaches.

Section #5: Medical Insurance
The purchaser and/or participant of the program or service will assume responsibility for medical costs incurred due to illness and/or as a result of the purchaser of the program and/or participant of the program’s participation in the program. The purchaser of the program and/or participant of the program agrees to pay for any costs related to their medical treatment.

Section #6: Damages
The purchaser and/or participant of the program or service will assume responsibility for damages that he/she inflicts on any facility or club premises.

Section #7: Photographs & Media
The purchaser and/or participant of the program or service consent to the use by Mission Elite Performance for any photographs/media taken and distributed for publicity, advertising, promotions, and/or other professional purposes.

Section #8: Equipment
The purchaser and/or participant of the program or service will be expected to enter the program with his/her own equipment, except for tennis balls.

Section #9: Agreement Outside the Contract
The purchaser and/or participant of the program or service agrees that he/she has entered into this contract of their own volition and is of sound mind and body.

I, the purchaser of the program and/or participant of the program, acknowledge that I have carefully read this agreement and fully understand its contents and meaning. I further acknowledge that this agreement will absolve and release Mission Elite Performance from any liability in connection with any injury or harm suffered due to my/my player’s participation in any or all Mission Elite Performance programs or services. I acknowledge that I have been made aware of all risks of participation in the programs or services.

Section #10: Registration
As the purchaser/participant, I understand that my spot will not be secured until 7 days before the week of the program I register for. Spot security in any programs or services will be based on the highest UTR players that register. I understand that I will be refunded 7 days prior (or be moved to the next week if possible) if my spot is not secured.

The registration is binding. The consideration of the participants takes place after registration. Canceling after the start of activities is not permitted due to our obligations to the other participants. If participation is not possible after registration for urgent reasons, the following rules apply:

• Unattended group courses are non-refundable, and missed programs or services cannot be refunded or rescheduled.

Section #11: Weather or Training Disruption
In the event of weather or training disruption, we will take the following steps in the following order:
1. Move training indoors
2. Move training online
3. Provide additional training time slots available.
4. Provide credit for future training time slots.
5. Issue a refund.

Section #12: Children or Youth (Juniors 18 and under)
The parents and guardians are responsible for supervising their children outside of training hours.

When booking, the parents and guardians are responsible for ensuring that any participant is of the correct age or UTR level for that program or service. We reserve the right to refuse entry to a program or service if any participant is not of the correct age or UTR level. In these circumstances, there will be no refund.

Lateness in Picking Up: We have the right to remove any children whose parents are late picking their child up more than once during a program or service. In these circumstances, no refund will be issued. It is the responsibility of the parents and guardians of the junior(s) to drop off and pick up their children in a timely manner.

Section #13: Acceptance of Terms and Conditions
The Terms and Conditions apply equally to all programs and services by Mission Elite Performance.

All parties, which include all adults and parents and guardians of juniors, are made aware of these Terms and Conditions. Participation implies acceptance of the Terms and Conditions as set out above.

Submitting online or other methods of registration and payment through the Mission Elite Performance Tennis website or submitting payment in any form, i.e., e-transfer, cheque, etc., implies acceptance of the Terms and Conditions as set out above.

Section #14: Website
We make every effort to ensure that the details on the website or in the flyers are correct. Still, we reserve the right to amend any errors at any time and will inform you of any changes.
• All rights, including translations, reproductions, and reprints of training materials, even in extracts, are reserved. No copies may be made without the written permission of Mission Elite Performance.
